Wimmer found guilty

Scott Allan Wimmer has been sentenced to a year of probation and 24 hours of community service after being convicted of drunken driving and fleeing the scene of an accident in January this year.

The NASCAR driver was given a 60-day suspended prison term, served only if he violates probation, and will lose his driver's licence for one year. He also had to undergo an alcohol assessment, which satisfied the last term of the sentence.

Wimmer, 28, was arrested on January 31 for driving under the influence of alcohol after he wrecked a 2004 Dodge Ram pick-up truck owned by his team Bill Davis Racing. His lawyer, Chuck Alexander, says he will appeal the decision in order for him to keep his licence until the appeal is resolved.

Police had found some of Wimmer's possessions near the truck while they later found him in his High Point home, crouched beside his bed and bleeding from a head wound. His wife, Judy Ambrose, was found not guilty of charges that she impeded the investigation by lying to police over Wimmer's whereabouts.

NASCAR officials have so far withheld comment on the Nextel Cup rookie's conviction, but a driver's license is not a requirement to compete in NASCAR, competitors require a NASCAR licence.

Wimmer moved up to the Nextel Cup last year after three seasons of racing in the Busch Series.
