Court withdraws Coloni seizure order

A Belgian court has withdrawn the seizure order of the GP2 cars and truck belonging to Coloni Motorsport

The team was forced to miss the Spa round of the championship when its equipment was seized through a court order imposed by lawyers acting on behalf of former GP2 racer Andy Soucek.

Team boss Paolo Coloni told AUTOSPORT last week that the action was triggered by an ongoing legal case between Soucek and Fisichella Motorsport International - the previous incarnation of the team the Spaniard was briefly contracted to last season.

A statement released by Coloni today announced that the Belgian Court of Verviers has withdrawn the order, which the team claims was made with "absolutely no grounds".

Coloni was fined 80,000 Euros for missing the GP2 races in Belgium and now says it "reserves the right to act for its own protection in every appropriate court, in the civil, penal and sporting fields".

A statement released by Andy Soucek after Coloni's cars were impounded at Spa confirmed that he had taken the action because "the dismissal of Mr. Andy Soucek as driver for the Team FMSI five days before the 2008 GP2 season start was a clear breach of contract from FMSI's side, a fact that has been recognised by an arbitrator in FMSI's hometown of Perugia.

"There have been several occasions in which [Andy Soucek Motorsport] tried to reach an agreement with FMSI regarding the outstanding amount, but the offers made by FMSI were simply unacceptable for our interests (in fact, the amount offered was only a small percentage the amount awarded to ASM by the Italian arbitrator)."
