Toro Rosso appeal date set for next Friday

Liuzzi was given a 25-second penalty after the race stewards felt he had overtaken Adrian Sutil for eighth place while yellow flags were being waved for Anthony Davidson's stricken Super Aguri.

Speaking in China, Tost revealed that the appeal hearing has been set for October 12 and will be heard in front of the FIA International Court of Appeal in Paris. And he is confident that the original stewards' verdict will be overturned.

"It was quite obvious and totally clear that we stayed within the regulations," he said.

Tost said the issue revolved around the fact that marshals were not waving green flags at the end of the incident, so it is unclear from on-board footage where the yellow flag area ended.

"When no yellow flag is being waved, it means there is no yellow flag. For me, marshal Post 1 should have waved green. They didn't wave green. It was a mistake from their side.

"But this doesn't mean for me that a driver has to be penalised, because it's their fault, not the drivers' fault. When I am sitting in the cockpit as a driver, if I don't see a yellow flag being waved, then for me it's green. It's the same as green. And this is what Tonio thought as well.

"I would have accepted a penalty if Tonio had overtaken on the start/finish line. But at marshal Post 3 (the exit of Turn 1) it is far away."
