TMS progresses NASCAR negotiations
Texas Motor Speedway near Fort Worth is reported to be in line for a second NASCAR Nextel Cup fixture without a trial in the delayed case brought by a private shareholder in track owner Speedway Motorsports Inc [Oct 31]. After SMI's board refused to sue NASCAR, Francis Ferko filed his own suit in the South District Court in Sherman, TX, alleging that NASCAR had breached contracts by not placing a second Cup race at TMS. Progress is now being made in settlement negotiations
A lawyer for the plaintiffs in the suit said that talks with NASCAR were ongoing, and asserted that these appeared to be progressing towards a settlement. "It's in the best interest of the sport that we get this behind us," NASCAR spokesman Jim Hunter also confirmed. "As far I know, there are talks under way."
Neither TMS nor SMI, which owns and operates it and five other US tracks, are directly involved in the litigation. TMS president Eddie Gossage had no comment, although he and SMI chairman Bruton Smith have contended since the $250m track opened in 1997 that they have not been given a second date by NASCAR as promised. NASCAR insists that it never promised TMS another race.
All seven NASCAR races at TMS have sold out and another crowd of more than 200,000 is expected for the Samsung/RadioShack 500 on April 4, 2004.
