Aston loses appeal against exclusion

Darren Turner and Tomas Enge won the race in their DBR9, but were disqualified when the car was found to have too much wear on the plank underneath.

The team admitted that a section of the plank was worn away beyond the limit but appealed the exclusion despite the mistake, calling for leniancy from the FIA because the car had never run a plank before the start of this season.

But Tuesdays's FIA International Court of Appeal supported the decision of the stewards and confirmed the exclusion.

A statement from the hearing read: "The court, after having heard the parties and examined their submissions, declared the appeal admissible and confirmed the stewards' decision, on the ground that the friction block of car #7 was not in conformity with Article 257.3.3.2.d.3 of Appendix J of the 2010 International Sporting Code, as the 5mm tolerance does not apply to the minimum thickness of the friction block, but only to the flat bottom of the car."

The Sumo Power Nissan of Warren Hughes and Jamie Campbell-Walter retains its victory.
